Terms of Service

1. Acceptance of Terms

By accessing or using SchoolNest ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service. The Service is an education management platform for schools, teachers, parents, and students operating in Nigeria. These terms are made in accordance with the laws of the Federal Republic of Nigeria, including the Federal Competition and Consumer Protection Act 2018 (FCCPA) where applicable.

2. User Accounts and Roles

You may use the Service as a school administrator, teacher, parent, or student according to the role assigned to your account. You must provide accurate and complete information when registering and keep your credentials secure. You are responsible for all activity under your account and must notify us promptly of any unauthorized use. Parents may link to student accounts as permitted by the school. We may require verification of identity or authority where necessary for the security of the Service.

3. Description of Services

The Service provides school management tools including attendance, grades, fees, messaging, timetables, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice where practicable. We will use reasonable efforts to maintain availability but do not guarantee uninterrupted access. Services are offered subject to these terms and to our agreements with schools where applicable.

4. Acceptable Use and User Responsibilities

You agree to use the Service only for lawful educational and administrative purposes and in accordance with these terms and applicable Nigerian law. You shall not: misuse or attempt to gain unauthorized access to the Service or others' data; upload malicious code or content; harass, bully, or defame others; or use the Service in any way that violates applicable laws, regulations, or school policies. You are responsible for content you post and for ensuring that your use complies with the Child's Rights Act and other relevant Nigerian legislation. We may suspend or terminate accounts that violate these terms.

5. School Data and Content

Schools and authorized users may upload and manage data (e.g. student records, grades, attendance) through the Service. You represent that you have the right to provide such data and that it complies with applicable privacy and education laws in Nigeria, including the Nigeria Data Protection Act 2023 (NDPA) and any guidelines issued by the Nigeria Data Protection Commission (NDPC). SchoolNest processes this data as described in our Privacy Policy and in accordance with our agreements with schools.

6. Intellectual Property

The Service, including its design, features, and content we provide, is owned by SchoolNest or its licensors. You may not copy, modify, or create derivative works of the Service except as necessary to use it as intended. Your data remains yours; we do not claim ownership of content you submit. You grant us a limited licence to process and display your data as needed to operate the Service.

7. Disclaimers and Limitation of Liability

The Service is provided "as is" and "as available." We do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose. We are not responsible for decisions made based on data or reports generated through the Service. Use of the Service is at your own risk. To the maximum extent permitted by the laws of Nigeria, SchoolNest and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of data or profits, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim, if any. Nothing in these terms excludes or limits liability that cannot be excluded or limited under Nigerian law.

8. Termination

We may suspend or terminate your access to the Service for breach of these terms or for other reasons with notice where required by law or our policies. You may stop using the Service at any time. Upon termination, your right to use the Service ceases; we may retain or delete your data as described in our Privacy Policy. Provisions that by their nature should survive (e.g. indemnity, limitations of liability, governing law) will survive termination.

9. Governing Law and Dispute Resolution

These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any dispute arising from or in connection with these terms or the Service shall first be attempted to be resolved amicably. If resolution is not achieved, the dispute shall be subject to the exclusive jurisdiction of the courts of Nigeria. You may also have rights under the Federal Competition and Consumer Protection Act 2018 and may refer complaints to the Federal Competition and Consumer Protection Commission (FCCPC) where applicable.

10. Changes to Terms

We may update these Terms of Service from time to time. We will post the updated terms on this page and update the version and "Last updated" date. Continued use of the Service after changes constitutes acceptance. For material changes, we will provide additional notice where reasonably practicable (e.g. by email or in-app notification). If you do not agree to the updated terms, you must stop using the Service.
